So, over on OS the other day, I learned something I thought I knew, but didn't. Redshirt replied in a thread about passing I believe, after someone mentioned the attributes effect slider. Short version, if you want the guys to play strictly to their ratings, you put that thing in the middle, and presto. Pure game.
On the default, which is almost at the top, it smooshes together guys at the top of the ratings, and I guess keeps lower ratings guys down, or at least spreads things out.
So, for example, at the top, a guy with 95 speed becomes almost like a guy with 99 speed, and thusly I guess a 75 speed becomes closer to 70.
I guess in a way, the default sliders helps the ace players be way better then the slugs, but it also makes MORE guys seem like ace players.
I have only had a chance the past few days to try this slider in one game, but I immediately noticed that Taylor Hall seemed to have an extra step around some slow D men.......
I'm going to play some more and see if it was true, or if i was just hallucinating.....

I've settled on tuner set 1.03 for now.
Set 1.01 is fluid and fun but almost too loosey-goosey. Too easy to break out of the defensive zone and cross the blue line on the rush.
Set 1.04 is a joke. I see little or no increase in penalties on default Pro, especially on the CPU. And the CPU skaters seem to have gained a speed or aggressiveness boost. They're all over the puck in the corners on rebounds and forecheck like they're on bath salts.
Tuner set 1.03 has the best play balance for me. Not enough penalties, but no tuner has fixed that flaw yet.

I'm seeing on average 2-3 penalties per 6 minute period using 1.04.
I'm also not seeing the boost by the CPU like you mentioned PK. The attribute slider seemed to make a difference as well. Then again, I'm playing on PRO so YMMV.

I have the attribute slider at halfway, or three clicks. Strange that you are not seeing an increase in penalties. I do think that it's wildly inconsistent. I think, based on past tuner write ups, that the Ai is a bit more aggresive at AS than at Pro. I just played a game this morning against the Caps, and they took 4 or 5 penalties against me. Some are BS "roughing" calls, but I applaud the increase in overall PPs in a game, even if some of them are a bit chincy. 
So, maybe on Pro they just aren't aggresive enough to give you enough penalties? Are you playing with the penalty sliders jacked up?

Yeah, I'm on AS with penalties all the way up, 8 minute periods and the attribute slider in the middle and see 4-6 penalties on average per game.
I can't kick off my franchise until Tarasenko is in the game though.

The predominant impressions at OS is that folks are getting enough penalties. It's too bad that 1.04 is failing to work for you, PK. But it is working well for most.

There is a Penalty slider under Rules I believe, and then under AI there is a CPU Teammate Penalty slider, and a CPU Penalty Slider, which controls how often AI controlled folks will commit a penalty.

New patch out, 1.05. Fixes soft shots on long goals by CPU in all modes, which is a welcome tweak.
I've realized after playing nearly 100 games of NHL 13 offline that the problem in my team's defensive end isn't my CPU teammates -- it's me chasing the puck too much as a defenseman. So I've adopted a new strategy with good success and more realism -- I only control forwards and back-check like mad on defense. The only time I control a D-man is while controlling a rebound or while retrieving a dump-and-chase attempt by the CPU.
My defense is much less leaky when playing this way, proving the problem was me, not the AI.

A good tip for forward or Defensemen is less is more.
If you lay off the stick and mostly glide your player will break up passes and intercept pucks on his own, especially with d men, i find if i try to poke to intercept a pass it usually gets thru unless your dead on it, so if you just stand there or are at least only gliding you will have much more success with getting your stick on the puck.
Sprinting is your enemy this year.

I've finally determined that NHL 13 offline would be perfect if EA could combine the superb gameplay of Tuner Set 1.01 with the increased penalties of Tuner Sets 1.04 and 1.05. That would be nirvana.
