Already have two calls in to Dallas attorney pals. I need to see that opinion. There are a few ways that the court could have jurisdiction, but none of them seem particularly likely given these facts. My guess is that it's just Hicks calling in a home field favor to try to bust the balls of Broughton and the board. Maybe hoping he can scupper the NESV deal to force a sale to one of these pie-in-the-sky bidders he's been touting.

Liverpool fans aren't too bad, been to Anfailed a few times with City and never had any bother at all. Now Goodison, that's a different tale - their fans are the dregs of sub-humanity. Thx for the link, Dave. I had a copy last night and spent several minutes screaming at it and Hicks' petition for the TRO.
Quite interesting. Hicks' petition laid out a not insubstantial argument for jurisdiction. Surprisingly though, the TRO makes no mention of jurisdiction whatsoever. In my experience a thorough judge and clerk will always, even in the most exigent of circumstances, make some statement about jurisdiction in a case involving parties with potential jurisdictional challenges.
I'm very curious to see who the independent directors and RBS use as counsel in Dallas. They may also want to move on an emergency basis, rather than passively waiting for the 25th to be heard.
This situation is absurd and nerve wracking.

RBS are royally pissed off about it. The take over here is that NESV don't believe that the Texas courts have jurisdiction in this case, but that they are worried about ignoring them completely in case they have other dealings with these courts.RobVarak wrote:Thx for the link, Dave. RBS and the board win a counter-injunction against G and H, with some rather scathing remarks directed by the judge at at the summary of the case presented to the Texas court. Got to love jurisdiction shopping. Actually a very good example of why at my hospital we're always requiring contracts to stipulate jurisdiction as that of Ontario and Canada. There are few things as problematic as litigation in a foreign jurisdiction.

RIP Big Malcolm Allison - City coach alongside Joe Mercer in the time they were really winning things (68-72). Twenty years ahead of his time in terms of tactics and man management, but unfortunately not really suited to the top job on his own, as a later stint as City manager in 79-80 demonstrated. Very knowledgeable about the game, though, and a joy to watch on TV panels.
A genuine character, the like of which seems almost gone from soccer nowadays. As someone once said, if you arranged a game between the best 11 players in the world and 11 supermodels, the camera would still follow him.

I have an admission, after the discussion above.
I dislike Liverpool FC.
I despise Liverpool (the city) and its inhabitants, but
I absolutely f**king hate everything to do with Everton FC. Their shitty ground, racist fans, self-pitying manager, bumbling 'poor-me' chairman, stupid Z-Cars music...
So, in the pantheon of likely results, I'd like a Liverpool victory...hopefully a last minute penalty.
I'm actually hoping for 6 red cards and a couple of managerial bust-ups, I'd like to watch Gollum blow a fuse.

There was no way to build a stadium, invest in international marketing or compete in talent markets as long as they were hampered by the acquisition debt. Now that they are debt-free (essentially), NESV can make the improvements necessary to become competitive again. It won't be of the petrol-dollars dropping from the sky-variety, but NESV has more than enough capital to invest in talent, the Academy, marketing etc.JRod wrote:World Soccer Daily made this exact point. The stadium is a distinct issue, because there are political, banking and real estate variables that complicate things. OTOH, Henry is intimately familiar with the idea of wringing money from a franchise with a venerable brand stuck with an outdated stadium. Seems likely to me the first unhappiness from the Scousers will be over skyrocketing ticket prices.

An European owner would have been ideal. For Liverpool fans, JH maybe a slight upgrade over Gillette-Hicks but it'll take awhile to fix this franchise. The latest rumor is that David Ortiz may play midfield for the Reds.

Ramping up the ticket prices - Armageddon. Merseyside as an area is still, I think, the only area in England that is eligible for objective 1 European funding, which you only get if the region's GDP per head is less than 70% of the EU average. The other areas of the UK which were previously eligible dropped out when the poorer E European joined the EU...but not Merseyside. Trying to go down the £60 a ticket route will not work here.
So as well as dropping the £200-odd mill to wipe out the debt, they are looking at a new stadium development. And the City Council will have nowt to throw in the pot...local authorities in the UK are about to get large cuts in the central allocation from the Government announced next week.
They'd have been better buying Neverton, could have had them from Kenwright for about £40m.
And does anyone know whether Henry is the owner of 100% of the shares, or did Hicks sell his to this Mill crew ?

NESV is the 100% owner. The Mill deal never went through.
