The NCAA makes sense as you have tons of ACTUAL college teams that are not in the game, that will play a schedule this year.

I'm not missing that fact, bd. EA is not creating the teams, rosters, etc., but they are HOSTING it, which makes them liable (in theory). And the fact that Papyrus, etc. have done similar things in the past, without getting sued, doesn't really mean a whole lot. EA sold NCAA for how many years before they got sued by the old college football player this year? And EA sold Madden for how many years before the NFLPA (and now EA) got sued by the retired players? The suit may not happen this year, but believe me, it will happen. And if it makes it past a motion to dismiss, it will certainly have EA's attention. They're skating on some thin ice, and anyone who thinks otherwise is kidding themselves, IMHO.

Ian said he was the one who brainstormed the Team Builder feature. Why do you think it wasn't added to Madden?
I'll answer it for you...Ian admitted over at OS weeks ago that the feature wasn't added to Madden because of legal reasons.
I can guarantee you that someone at EA greenlighted this feature long before these lawsuits came about. That person is holding his or her breath right now that his/her decision doesn't come back to cost EA TONS of money somewhere down the road.
Whether you believe the suit has merit doesn't matter. What will matter is when EA starts hosting all of the user created rosters and the game comes out in a few weeks, and the first lawsuit is filed sometime after that. No matter how much you love EA (or how much I've hated their past business practices), they're skating on some thin ice with this.
Enjoy the feature while you can.
And trust me...it pains me a little to say that, since I'd like to see BackBreaker use a similar tool whenever it's released. From a legal standpoint, it's just not worth the risk.

One last point before I leave the subject. I just saw over at OS that people already have some VERY NICE uniforms up for the Rams, the Jets and the Saints.
If BackBreaker were to release with a similar Team Builder tool, how long do you think it would be until EA and the NFL moved to block any sale of the game?

Here is the truth I won't even use this feature so I could care less. I just don't see this becoming a problem.
Didn't marvel try to bring a law suit against the company that makes city of Heroes and didn't it get thrown out of court?
How do all the soccer games come with an editor?

It does beg the question though...why should EA (or any developer) pay the NFL anything for its license, if us gamers can do just as good a job creating the Steelers, Jets, Saints, etc. using this tool? The people over at OS are already doing a heckuva job doing just that.

I know I don't care enough about College football to use this, in a baseball game i would go to town creating historic rosters so i could replay the 75 season say.
Who knows you might be right and the whole thing might be shut down, maybe EA made some secret deal. I don't know but it would be nice to see nothing come of this and have this feature added to other games.
The trend in gaming these days is user content, see said City of heroes, Valve games, Bioware games. Maybe sports games are going to get on board.

I'd also love to go to town creating historic teams, rosters and stadiums for some old baseball seasons.
