I don't see how this could be the game publisher's responsibility. Publishers don't get a cut from re-sells so their only "contract" is with the original customer and the retailer, not with someone who buys second hand.

I can pitch great for 7-8 innings and then all of a sudden the CPU hits everything everywhere. Two situations happen a little too frequently. I will have a large lead late, then the CPU will make it close with multiple runs in the 8th or 9th ...

I can't make it tonight because of work but my schedule will clear up next week.
