The kid gets that angry and vengeance seeking after a harmless take out, which was probably his own fault BTW, then he definitely had some issues.
He shouldn't have been that close to Stewart's right rear high side on the turn. You know Stewart's car is going to slide out to the right. He basically
wrecked himself. I don't even know if Stewart knew he was back there. He sure as heck wasn't expecting some hothead to come marching towards
his car on the track. I don't even think he two had any prior history or bad blood between them.

Ongoing, they'll keep reviewing information. He hasn't been "cleared", but if there was anything indicating he did anything wrong (which is nuts), he'd have definitely been arrested at this point. They're probably waiting for it to calm down a bit before it quietly goes away, or they have some small 1-line press release from the Sheriff's Dept.

I accept Terry's analysis from the racing side of things and I agree it's highly unlikely that he'll face any criminal charges. I'd be positively astounded if there isn't a civil suit even if he is not indicted.

And the civil side is still nutty, but I have no faith in civil law. A guy got out of a car on a RACE TRACK, and got hit. There should be no liability except the ultimate price the guy already paid.

However, Stewart would probably settle just to be done with it, which is probably what will happen.

Gutless, small-town district attorney. He's not up for re-election until 2017, so what's the political risk to do the right thing and not press charges?

That was the first thought I had. Seems like a cowardly move. Instead of saying there's not enough evidence and having a public backlash, and you don't have enough to charge him--lay the blame on the grand jury if they decline to indict him, or say you knew it all along if they do.

Toxicology reports sometimes take quite a while to be processed in labs, especially depending on the location. This accident didn't take place in LA or New York -- Ontario County is in the sticks, dude.
