I wouldn't go quite that far. While for practical purposes many of us don't spend considerable hours on 'past-gen' games, if I want to hook up my Dreamcast and let my kids play Ecco or Crazy Taxi, or if I want to play through Lunar: SSSC for PS1 with them (did just this), I should have the choice to. So I think an appropriate EOL strategy for consoles which may see $3K or more invested in them over them life of the system is a necessity. Of course, I'd like them to *state* that in plain english. On the other hand, if the capability to 'switch' it off exists, they may not want to let on for fear of inviting the chippers and modders of the world.

I'm not saying you shouldn't but you must realize you and the few others like you on this board are exceptions and not the norm. In terms of digital distribution. I've got original copies of PC games that I have re-purchased on Steam on sale just so I can have it in my library. I know I am not alone in doing that either. Hopefully it will lead to sales like GoG is having today. the entire D&D collection for $21, The first 6 Might & Magic games for $6.
I highly doubt console maker will ever go there but you never know.

I'm not claiming to speak for all gamers, I'm asking that the hardware providers employ a strategy that gives the end-user the right to use their purchases beyond an arbitrary kill date and I hardly think that's unreasonable. Perhaps not quite as steep but we do see discounted games from past gen on WiiWare and XBLA. I will be very interested to see how this gen plays out WRT DRM on the respective platforms.
MS has attempted to define DRM implications up front, to the ire of many.
Sony has taken the stance that "publishers may" but that first-party games will not place any restrictions on digital rights.
It has to be believed that both Sony and MS have gauged the interest from their publishers in such models.
The position from the publishers, themselves, is varied and uncertain.
*If* the consumer backlash is significant, and there are early signs that it may be, publishers may flee from the model in droves, leaving MS to twist in the wind and making Sony look brilliant in comparison.
OTOH, if publishers *really* desire the model and probe such solutions on the PS4, Sony may have a mish-mosh of implementations (at cost to individual publishers) reminiscent of their online solution vs the coherent Xbox Live of last gen.
In the case of XBL vs PSN, Sony has finally conceded their model to MS's. It will be interesting to see how this round of the battle plays out.

I'd imagine the majority of publisher are going to implement the same thing they do now, the online pass. People are use to it so I don't think the uproar would be too bad.
As you said though what if a publisher wants to publish on Xbox and PS and need to spend extra $$$ to implement and maintain the online pass for their game on the PS. That is something I had not considered.

That's what raised an eyebrow for me. I am assuming that it means you simply have to get back online within 24 hours of turning the XBox on or you won't be able to play, but given how convoluted some of MS's answers have been, who knows.>Current plan is basically you’re f***ed after 24 hours. It's also an inconvenience. There are times I take my console with me -- vacation, over to someone's house -- where there is not wireless broadband and hooking up to the router is not convenient. Again, not a dealbreaker necessarily, but again, more money for the possibility of more hassle. Plus, it is slightly insulting to have a company assume you are a thief unless you prove otherwise.

My son got the Xbox Disc for Minecraft for his birthday and graciously accepted it from his Grandmother even though we've had the D/L version since the first week it was available. When I tried to ask for credit from my local Gamestop the kid backed away from it like it was cyanide because it was still in the wrapper. He goes on about how the game might be a stolen copy and there's nothing he could do unless I wanted to open it and come back... SMH. Microsoft to Pull Complete Reversal on Xbox One DRM Policies

Sources indicate Microsoft is going to move away from what's caused the company so much headache.
The tug-of-war between Microsoft and Sony just got more interesting. Multiple sources inform me Microsoft will announce what amounts to a complete reversal on its DRM policies for Xbox One today.
What does this mean?
No more always online requirement
The console no longer has to check in every 24 hours
All game discs will work on Xbox One as they do on Xbox 360
An Internet connection is only required when initially setting up the console
All downloaded games will function the same when online or offline
No additional restrictions on trading games or loaning discs
Region locks have been dropped
It is unclear what caused this huge change in policy right after E3, a week where Microsoft executives spent days explaining, justifying, and talking about its policies to the press. I suspect Microsoft’s official announcement will say something to the effect of “we've been closely listening to consumer feedback.”
